The Subdivision and Development Servicing Bylaw No. 3419, 2010 was adopted by Council on August 24, 2010.  It repealed the previous Subdivision Bylaw No. 3538, 1983 and the Frontage Improvement Bylaw No. 2709, 2000.

The purpose of the Bylaw is regulate the subdivision of land and requires the provision of works and services (as outlined below) in the subdivision and development of the land and to prescribe the standards for infrastructure installed.

It is important for the City to prescribe the standards as the City is the operator of the infrastructure and is responsible for future maintenance and operation and therefore is and should be concerned with how infrastructure is originally built. 

This bylaw is applied to all subdivisions, including two lot subdivisions, and all development which is defined as construction of any structure that requires a building permit with the exception of a single detached or two-unit house and a detached garage or accessory structure.

The ability for local governments to require works and services as they relate to subdivision and development (i.e. building permits) is provided through the Local Government Act section 938 (6).

In general, the works and services required may include; utilities (water, storm, sanitary sewer mains) roadway, curb and gutter, sidewalk, street lighting, undergrounding of overhead wire, and street trees. The Bylaw provides maps that outline appropriate standards for different sections of the City.  This includes a ‘rural’ verses ‘urban’ standard for streetscape, required and optional locations for undergrounding of overhead wires and areas that require specialized street light fixtures.

The Approved Utility Product List is supplemental to the 2010 Design Standards as laid out in the Subdivision and Development Servicing Bylaw No. 3419, 2010. It lists all municipal infrastructure products approved for use within the City. All updates and inquiries are coordinated through the Land Use Services Department.
